Lady day next, or at the end of such year of your texancy as shall first happen after the expiration of half a year from the date hereof. Dated this 29th day of September 18-. Witness E. F. C. D.

This notice was framed agreeable to the advice of Mr. Serjeant Bayley, (now Judge Bayley,) whose opinion was taken on the subject; (see my cases and opinions illustrative of the theory and practice of conveyancing.) It should seem that it will not be safe to bring an ejectment on the above notice, till the expiration of a year and a quarter from the date, for supposing (which to be sure is the extreme point,) that it should turn out, the tenancy commenced on the preceding quarter to that on which the notice was served; in such case no half year's notice could have been given which would meet the tenancy, except one that would not expire till the period before alluded to.
